Property Division In North Carolina

North Carolina is an equitable distribution state, meaning that marital assets and debts are divided equitably between spouses. The term equitable means fair and just.

Property acquired during a marriage is typically classified as marital, with limited exceptions. Separate property includes property acquired by a spouse prior to a marriage and limited property acquired during a marriage, including property acquired by gift or inheritance.

In North Carolina, there is a presumption that a 50/50 division of marital assets and debts is equitable. However, the Court does have the discretion to consider other factors and award one of the spouses a greater percentage of marital property or debt. It is critical that you have a highly qualified divorce attorney who can negotiate a favorable division of property on your behalf or make a compelling case on your behalf at trial if your case is not able to settle.

We Tailor Our Services To Meet Your Needs

We understand that each family law case is different and each of our clients has different needs and objectives. Some of our clients are most concerned about the award of the marital home, while others are most concerned about investment accounts and other liquid assets.
